A. Scope and application of the Nelson Education Ltd. Privacy Policy (the "Privacy Policy"):

We value the trust that you have placed in our business and are committed to prioritizing your privacy. This Privacy Policy is our way of making sure you are fully informed and affirms our commitment to maintaining the accuracy, confidentiality, and security of Personal Information. We will not collect, use or disclose your Personal Information without your informed Consent, unless required or permitted to do so by law. Read through this policy so you understand how we use, share and store your data.

In this Policy "Nelson Education", "we", "us" or "our" refers to Nelson Education Ltd. and all companies providing services under the brands of Nelson Education, including but not limited to affiliates and related entities, and any successor company or companies thereof, as a result of corporate reorganization or restructuring. "You" refers to anyone who visits our website, our clients, students, teachers, education professionals, and anyone who engages with our products, services and offerings. Other key terms used in this Privacy Policy are defined at the end of this Privacy Policy.

1. Who this Privacy Policy Applies to

This Privacy Policy applies to Personal Information about Individuals who interact with Nelson Education and/or who engage with our products, services and/or offerings, and Nelson Education's Collection, Use or Disclosure of such Personal Information.
This Privacy Policy applies to the management of Personal Information in any form, whether oral, electronic or written.

2. Exclusions from Privacy Protection

The Privacy Policy does not impose any limits on the Collection, Use or Disclosure of the following information by Nelson Education: (a) aggregate information that cannot be associated with a specific Individual, such as demographic statistics about Nelson Education customers, or number of visitors and average time spent on a website; or (b) information that is otherwise determined not to be Personal Information pursuant to, or is not regulated by, applicable privacy legislation. This Privacy Policy does not apply to Personal Information about our employees.

3. Note to Children

Although parts of Nelson Education's website provide information and activities for or relating to students, we do not knowingly accept any Personal Information from or about children without parental or legal guardian Consent. Teachers, parents or legal guardians must provide their own information (Personal Information or otherwise), or parents or legal guardians must Consent to the Collection, Use and Disclosure of their child's Personal Information in accordance with the terms of this Privacy Policy, in order for students to participate in our services or products.
Nelson Education encourages parents and teachers to spend time with children and to monitor their online activities. Please protect your child's privacy by instructing them to never provide Personal Information on this website or any other, or within any software registration process, without your permission.

4. Types of Personal Information Collected and Purposes for its Collection

The types of Personal Information Nelson Education collects is reasonably connected to the reason (purposes) it was collected. The following are examples of the types of Personal Information collected and the purposes for which Nelson Education may collect such Personal Information:
(a) Tests, Assignments and Homework
Nelson Education may collect and use Personal Information submitted by teachers and students relating to educational assignments, homework and tests associated with the educational programs used by the teachers and/or students. The Personal Information collected may include student name, student ID, answers, responses and other information submitted, as well as marks and progress.
(b) Learning Assessments and Program Development
When Nelson Education is engaged to perform learning assessments and/or develop learning programs for individual students, Nelson Education, together with health and education professionals, will collect a wide range of information that is relevant to the assessment and/or program on the Individual in question, and in some limited instances, that may include relevant health information. Nelson Education may collect psychological assessments on students with various learning abilities including reports, learning outcomes, assessment notes, and education plans. This information is used to create tailored learning programs, assessments, and is used to provide educational services and products to students with various learning abilities. Health professionals who are involved in the assessments and program development are bound by strict laws on maintaining confidentiality and security of the information in question.
(c) Changes and Enhancements to Products and Services
Nelson Education may, from time to time, use an Individual's Personal Information to contact the Individual about changes, enhancements or similar notices related to Nelson Education's products and services.
(d) Offers and Information
If an Individual indicated that he/she was interested in receiving offers or information from Nelson Education or certain of our selected sponsors or advertisers, Nelson Education may send the Individual materials about products and services that Nelson Education feels may be of interest to the Individual.
(e) Contests and Promotions
If an Individual enters a contest or other promotion or applies for a scholarship offered on a Nelson Education website or by Nelson Education, Nelson Education may, under the rules of the promotion or applicable terms and conditions, use the Individual's name and certain other information reasonably required to administer the promotion or scholarship, such as contacting, announcing and promoting the winners of the promotion or the scholarship recipients.
(f) Applying for a Job
If an Individual applies for a position with Nelson Education, Nelson Education will collect Personal Information contained in and generated in relation to the Individual's application, in order to evaluate the Individual's application and assess whether to offer the Individual employment, which information is kept for a reasonable period of time, and may include Personal Information collected from Third Parties acting as references for the Individual.
(g) Purchasing Product or Service
When you purchase a product or service from Nelson Education or a website, you may need to provide us with contact and payment information (such as credit card information) so that we can process your request or complete your transaction and communicate with you regarding your purchase. We may also need to collect contact information to provide certain services, including delivery services, reserve and pick-up, product servicing, in-home consultations or installations, and extended warranty coverage. If you provide us your email address, we will also collect your email address for the purpose of sending you an e-receipt. We also may use your contact information to send you promotional information.
(h) Returns
Our goal is to ensure that you are completely satisfied with your purchase and to this end, Nelson Education offers a Return Policy. For Nelson Education to continue to offer our Return Policy, we ask for Personal Information such as your name, address, and telephone number for the purposes of detecting and preventing fraud.
(i) Provision of Services, Develop Relationships, Scholarships, Contests and Legal Compliance

Nelson Education collects and uses Personal Information for the following purposes: (a) to provide the educational programs, products, materials and services requested; (b) to establish and maintain responsible commercial relations with Individuals and to provide ongoing services; (c) for those purposes set forth in agreements between Individuals and Nelson Education; (d) to understand Individuals' needs; (e) to develop, enhance, market or provide products and services; (f) to manage and develop its business and operations, including personnel and employment matters; (g) to meet legal or regulatory requirements, including to protect or defend a legal interest; and (h) to review and assess an application for a Nelson Education scholarship, or your compliance with the eligibility criteria relating thereto.
(j) Customer Support
Personal Information may be collected in order to administer customer support services, including to direct your questions to appropriate individuals, and to investigate and address any of your concerns. Without limiting the foregoing, Nelson Education operates customer support call centres to accept and address your questions, concerns, or complaints. When you contact our call centres, we may ask for Personal Information to help us respond to your inquiry or to verify your identity. For example, if you have a question about the status of a recent online order, we will ask for Personal Information to verify that you are the account holder. We may also monitor or record your telephone discussions with our customer support representatives for training purposes and to ensure service quality. If you do not want your call to be monitored and recorded, please let us know and we will provide you with an alternative means of communicating with us.
(k) Social Networking Sites
We may offer you the opportunity to engage with our content on or through third-party social networking websites, plug-ins and applications. When you engage with our content on or through third-party social networking websites, plug-ins and applications, you may allow us to have access to certain information associated with your social media account (e.g. name, username, email address, profile picture, gender) to deliver the content or as part of the operation of the website, plug-in or application. When you provide information from your social media account, we may use this information to personalize your experience on the website and on the third-party social networking websites, plug-ins and applications, and to provide you with other products or services you may request.
(l) Advertising
We or third parties such as ad networks and other advertising companies may serve advertisements on our websites and on other websites and social networking sites. We or those third parties may use cookies, tracer tags or web beacons to report certain information about your visits to our websites and other websites, such as web pages you visit and your response to ads, in order to measure the effectiveness of our marketing campaigns, better understand our users and to deliver ads that are more relevant to you, both on and off our websites. Nelson Education adheres to the Digital Advertising Alliance of Canada's (DAAC) Self-Regulatory Principles for Online Behavioural Advertising. To learn more and to opt-out of having your information used by participating companies for online behavioural advertising purposes, please visit https://youradchoices.ca/choices. Please note that if you choose to opt-out you must opt-out of each web browser on each computer, mobile device and tablet you use. If you opt-out of receiving interest-based ads, you will continue to receive advertising, but it will not be based on online behavioural information about you. We may also use services provided by third-party platforms, including social networking platforms, to serve you tailored ads. We do this by providing a hashed version of your email address or other information to the platform provider.
(m) Electronic Communication
If and when we communicate with Individuals using electronic means, such Individuals can opt out of receiving such messages by following the unsubscribe link included at the bottom of such communications or by contacting [email protected]. Any questions or concerns with respect to communications from Nelson Education may be addressed to such Chief Privacy Officer.

5. Disclosures and Transfers of Personal Information

(a) Provision of Services, Contests and Develop Relationships with Teachers, Students and Customers
Nelson Education discloses and/or transfers Personal Information for the following purposes: (i) to provide the educational programs, products, materials and services requested (including facilitating logging into to another Third Party's educational programs that are accessed through Nelson Education programs or services); (ii) to establish and maintain responsible commercial relations with Individuals and to provide ongoing services; (iii) to fulfill the terms of agreements between Individuals and Nelson Education; (iv) to understand Individuals' needs; (v) to develop, enhance, market or provide products and services which we reasonably believe may be of interest to you; (vi) to manage and develop its business and operations, including personnel and employment matters; and (vii) to review and assess an application for a Nelson Education scholarship, or your compliance with the eligibility criteria relating thereto.
(b) Third-Party Education Partners
Nelson Education may offer educational programs and services in conjunction with a third-party educational content partner. For example, Nelson Education may offer programs and services in conjunction with Cengage Learning. In that instance, Nelson Education may disclose and share Personal Information with such third-party educational content partners that is reasonably necessary to provide the educational programs and services requested.
(c) Learning Assessments and Program Development
When Nelson Education is engaged to perform learning assessments and/or develop learning programs for individual students, Nelson Education may also share Personal Information collected with teachers, parents, health professionals, and education professionals in order to optimize learning programs, products, and services. Health professionals who are involved in the assessments and program development are bound by strict laws on maintaining confidentiality and security of the information in question.
(d) Legally Required
Nelson Education may disclose Personal Information to meet legal or regulatory requirements. From time to time, we may be required to provide Personal Information in response to a court order, subpoena, government investigation, or as otherwise required by law. We also reserve the right to report to law enforcement agencies any activities that we, in good faith, believe to be unlawful. We may release certain Personal Information when we believe that such release is reasonably necessary to protect the rights, property and safety of others and ourselves.
(e) Business Transactions
You also understand that Nelson Education may use your Personal Information and disclose your Personal Information to Third Parties in connection with the proposed or actual financing, insuring, sale, securitization, assignment or other disposal of all or part of our business or assets (including accounts) for the purposes of evaluating and/or performing the proposed transaction, and you Consent to such Disclosure. These purposes may include, as examples, permitting such parties to determine whether to proceed or continue with the transaction, fulfilling any reporting or audit requirements to such parties, and/or disclosing Personal Information as part of concluding a sale or transfer of assets. Our successors and assigns may collect, use and disclose your Personal Information for substantially the same purposes as described in this Privacy Policy. In the event that the transaction does not go through, we will require, by contract, the other parties to not use or disclose your Personal Information in any manner whatsoever and for any purpose and to return or destroy same.
(f) Agreement Terms
Nelson Education may disclose Personal Information to Third Parties pursuant to and in accordance with the terms of agreements between Individuals and Nelson Education. To the extent there are terms in agreements governing the handling of Personal Information, such terms apply in addition to the terms set out herein.
(g) Service Providers
Nelson Education sometimes transfers Personal Information to others, including to affiliated entities or unrelated companies ("service providers"), that carry out certain functions on our behalf, such as order fulfillment, data processing, accounting and administrative services, customer service and information technology services including, without limitation, hosting and data storage services. In those cases, we require those service providers not to use or disclose Individuals' Personal Information for any purpose other than as directed by Nelson Education
If you believe that a Third Party has inappropriately disclosed your Personal Information to us, please contact that Third Party directly. If the Third Party does not sufficiently respond to your inquiries, please let us know immediately.

6. Third-Party Applications

Our website and any of our applications available from our website or Third-Party platforms are governed by the provisions and practices stated in this Policy. Our website and such applications may contain links to Third-Party sites or applications that are not governed by this Policy. Although we endeavour to only link to sites or applications that share our commitment to your privacy, please be aware that this Policy will no longer apply once you leave our website or such applications, and that we are not responsible for the privacy practices of Third-Party sites or applications. We therefore suggest that you closely examine the respective privacy policies of Third-Party sites and applications to learn how they collect, use and disclose your Personal Information.
In some instances, in order to access Nelson Education's education programs and services, you may need to go through Third-Party portals, such as Google Classroom. In those instances, the Collection, Use and Disclosure of your information will also be subject to the terms of such Third Party's privacy policy. We ask that you review those and confirm you accept those terms prior to proceeding. In some instances, the Third Party whose portal is used to access the Nelson Education's education programs and services may share certain Personal Information with Nelson Education. In such instances, the Personal Information provided to Nelson Education shall be subject to the terms of this Privacy Policy.

7. Transfers Outside Canada

Some of Nelson Education's educational partners and service providers may be located outside of Canada, including in the United States. As such, Personal Information that is shared or otherwise disclosed to such Third Parties may be collected, used, processed or stored outside of Canada for the purposes described in this Privacy Policy. Nelson Education takes reasonable contractual or other measures to protect Individuals' Personal Information while processed or handled by these service providers. If an Individual's Personal Information is located outside of Canada it will be subject to legal requirements in those foreign countries applicable to Nelson Education's service providers, for example, lawful requirements to disclose Personal Information to government authorities in those countries.

We want you to make good decisions and choices for how your Personal Information is handled. Nelson Education will not attempt to deceive Individuals into giving Consent. An Individual's Consent can be express, implied, or given through an authorized representative.
By providing Personal Information to Nelson Education, using our website or engaging with our social media, you are consenting to our Use, Collection and Disclosure of your Personal Information in accordance with the terms of this Privacy Policy. Providing Personal Information or authorizing a Third Party to disclose Personal Information to us signifies your Consent to Nelson Education's Collection, Use and Disclosure of Personal Information in accordance with this Privacy Policy.
If we require new or additional Personal Information, or if we wish to use your Personal Information in a manner different than as expressed herein or in another agreement with the Individual, Nelson Education will inform Individuals how their Personal Information will be used by Nelson Education.
Nelson Education, may collect, use or disclose Personal Information without the Individual's knowledge or Consent in circumstances where such Collection, Use or Disclosure is permitted or as required by law.

Subject to legal and contractual requirements, an Individual can refuse to Consent to Nelson Education's Collection, Use or Disclosure of Personal Information about the Individual, or an Individual may withdraw the Individual's Consent to Nelson Education's further Collection, Use or Disclosure of Personal Information at any time in the future by giving Nelson Education reasonable notice, unless: (i) the Consent is otherwise required by law or (ii) the use or Disclosure is permitted by law or is related to the legal or regulatory requirements described herein. If an Individual refuses to Consent or withdraws his or her Consent where such Consent relates to the provision of requested products or services, Nelson Education may not be able to provide the Individual, or continue to provide the Individual, with such products, services or information.

10. Internet Aspects

Information may be collected when an Individual visits all websites of Nelson Education ("Nelson Education Sites"). Although the information collected, used or disclosed on the Internet as described below often does not constitute Personal Information (and to the extent that such is the case, then the obligations under the Privacy Policy do not extend to such information), Nelson Education provides the details below about Internet aspects of Nelson Education services for the purposes of Disclosure about Nelson Education services.
(a) Internet Protocol Address (IP Address)
When an Individual's web browser requests a web page from another computer on the Internet, it automatically gives that computer the address where it should send the information. This address is called the computer's "IP address." For most users accessing the Internet from a dial-up Internet service provider (ISP), the IP address will be different every time the user logs on. Nelson Education may use the user's IP Address to:
(i) facilitate the diagnosis and remedy of a technical problem reported by the user or Nelson Education's technical team;
(ii) display (or allow the display by Third-Party advertising providers of) more appropriate and relevant content and advertising, such as content and advertising based on the user's geographic area; and
(iii) estimate user traffic from specific countries or organizations. Many IP addresses are commonly associated with Internet service providers, universities, or major corporations in specific regions or localities. Aggregate information derived from IP addresses may also be reported to advertisers.
(b) Cookies
A cookie is a small text file, which often includes an anonymous unique identifier that is sent to the user's web browser from a website's computers and is stored on the user's computer's hard drive. Cookies cannot be used to run programs or deliver viruses to a user's computer. Nelson Education may use cookies to:
(i) improve the operation and performance of the Nelson Education services and to make Nelson Education services easier and more convenient to use. For example, cookies help Nelson Education provide more personalized services by recalling user preferences on subsequent visits (e.g. language preference). Cookies also allow Nelson Education to save passwords and preferences for a user so that the user will not have to re-enter them on the next visit to a Nelson Education Site;
(ii) measure aggregate user traffic and demographic statistics related to Nelson Education services and advertisements (e.g. number of users, average time spent, average age and similar statistics). This information helps Nelson Education to better understand when to update, change or offer new services and provides Nelson Education with details as to the performance of Third Party advertisements and content. This information may be reported, in aggregate form only, to Nelson Education's current and prospective sponsors, advertisers and business partners. No Personal Information will be disclosed in such reports;
(iii) Nelson Education and Third-Party advertising providers may use cookies when serving advertisements on Nelson Education Sites. In some cases, advertisements from Third-Party advertisers are delivered to users (in conjunction with Nelson Education services) by such Third-Party advertisers, or by separately contracted advertising providers on their behalf, and not by Nelson Education; as such, the Third-Party advertisers' use of cookies is subject to their own privacy policies, not the Privacy Policy, and users should consult the privacy policies of such Third-Party advertisers;
(iv) most browsers are initially set up to accept cookies. If a user prefers, the user can reset his/her browser either to notify the user when the user has received a cookie, or to refuse to accept cookies. The user should understand that while Nelson Education does not require a user to use cookies, certain Nelson Education services will not function properly if a user sets his/her browser to not accept cookies. In most circumstances, the information captured cannot identify you as an Individual;
(v) tracking pixels consisting of a clear gif (also known as web beacons) are used in combination with cookies to help Site operators understand how visitors interact with their websites. A clear gif is typically a transparent graphic image (usually 1 pixel x 1 pixel) that is placed on a site. The use of a clear gif allows the Site to measure the actions of the visitor opening the page that contains the clear gif. Nelson may use clear gifs on this Site, in our e-mails, or in our advertisements on other websites. Nelson utilizes clear gifs to measure visitor behavior, to help us improve visitor experience, and to manage site content; and
(vi) Nelson Education uses analytics technology to obtain information to improve the usefulness of the Site. We measure and analyze non-identifying, aggregate usage, and volume statistical information from Site visitors in order to administer the Site, and to constantly improve the quality of our service and site performance. Information gathered may include, but is not limited to, the following: the activity of the Site visitor's browser when the visitor is viewing the Site; the site path of visitors; general information regarding the visitor's internet service provider and host, and the time visitors come to the Site. Please note that this is not Personal Information, only general summaries of our visitors' usage of the Site.
(c) Web Beacons
Certain Nelson Education services may contain electronic images known as "Web beacons" - sometimes called single-pixel gifs - that allow Nelson Education to count users who have visited those pages and to deliver co-branded services. Web beacons are not used to access Personal Information; they are a technique used to compile aggregated statistics about Nelson Education's service usage. Web beacons collect only a limited set of information including a cookie number, time and date of a page view, and a description of the page on which the Web beacon resides. Certain Nelson Education services web pages may also contain Web beacons placed there by Nelson Education's advertising partners to help Nelson Education determine the effectiveness of Nelson Education's Internet advertising campaigns.
(d) Additional Information
Nelson Education automatically collects certain information about the user's computer hardware and software. This information may include: browser type, operating system type, domain names, access times and referring website addresses. This information is used by Nelson Education to operate the service, to maintain the quality of the service, and to provide general statistics regarding use of the Nelson Education Sites.
Certain Nelson Education services may be co-branded and offered in conjunction with another company. If a user registers for or uses such services, both Nelson Education and the other company may receive information collected in conjunction with the co-branded services.

11. Retention of Personal Information

Personal Information shall be retained for such period of time as is reasonably necessary to fulfill its intended purpose and for a period thereafter to allow for questions and the exercise of rights in relation to the handling of such Personal Information. Depending on the circumstances, where Personal Information has been used to make a decision about an Individual, Nelson Education shall retain, for a period of time that is reasonably sufficient to allow for access by the Individual, either the actual information or the rationale for making the decision.
Nelson Education makes all reasonable efforts to delete or destroy Personal Information that is no longer reasonably necessary; however, Personal Information that has been stored and backed-up electronically or is unreasonably inseparable from other information may not be fully deleted.

12. Accuracy of Personal Information

Nelson Education makes reasonable efforts to ensure that Personal Information is as accurate, complete and up-to-date as is necessary for the purposes for which it is to be used. Despite our efforts, errors sometimes do occur. Should you identify any incorrect or out-of-date information in your file, we will remedy any such errors on as soon as reasonably possible. In the event that inaccurate information is mistakenly sent to a Third Party, we will communicate relevant changes to the Third Party where appropriate.

13. Security Safeguards

Nelson Education protects Personal Information by security safeguards appropriate to the sensitivity of the information. Nelson Education protects Personal Information disclosed to Third Parties by contractual agreements stipulating the confidentiality of the information and the purposes for which it is to be used. All employees of Nelson Education with access to Personal Information shall be required, as a condition of employment, to respect the confidentiality of Personal Information.

14. Openness Concerning Policies and Practices

Nelson Education makes the terms of its Privacy Policy and its information handling practices available to everyone. It is posted online and we direct people to it when they purchase products and services. Of course, anyone can ask for a copy of it and we will happily provide it. Nelson Education makes information available to help Individuals exercise choices regarding the use of their Personal Information.

15. Access to Personal Information

Individuals shall be informed of the existence, use and Disclosure of his or her Personal Information upon written request and subject to certain exceptions. In certain situations, Nelson Education may not be able to provide access to all of the Personal Information that they hold about an Individual. For example, Nelson Education may not provide access to information if doing so would likely reveal Personal Information about a Third Party or could reasonably be expected to threaten the life or security of another person. Also, Nelson Education may not provide access to information if Disclosure would reveal confidential commercial information, if the information is protected by solicitor-client privilege, if the information was generated in the course of a formal dispute resolution process, or if the information was collected in relation to the investigation of a breach of an agreement or a contravention of a federal or provincial law. If access to Personal Information cannot be provided, Nelson Education shall provide the reasons for denying access upon request.

An Individual can obtain information or seek access to his or her Personal Information by contacting Nelson Education's Chief Privacy Officer at the contact information set out in Section 19 below.

16. Risk and Risk Mitigation

Nelson Education takes great precautions designed to safeguard Personal Information, however, as you know, no system is perfect. Advances in computer and software capabilities and encryption technology, new tools and other developments used by persons looking to penetrate or hack Nelson Education's system may increase the risk of such a breach. If Nelson Education's network and other systems, or those of Third Parties, such as service providers, are compromised Personal Information may be accessed and used in an unauthorized manner. This can lead to phishing scams, identify theft, embarrassment and other harms.
We encourage everyone to use different passwords for each different online platform used. This is because if someone gets access to one password, they can't simply blanket all platforms to see if they can get access. Don't click on links if you don't know the sender or aren't expecting the email. Call Nelson Education at a number you know to be Nelson Education's, or send an independent email (meaning, don't reply to the email sent, but create a new email using an email address known to be from Nelson Education) to confirm whether or not we sent the message to you. We are happy to answer any questions you have, as your safety and security is important to us.

For myNelson, we follow PIPEDA recommendations related to breach notifications. We notify the affected parties of any data breaches, and provide periodic updates addressing progress and impact. We have processes on identifying, containing, eradicating, recovering from, communicating, and documenting security events. If required, we can also work with our customers to comply to their privacy breach protocols as needed.

17. Changes to Privacy Policy

If Nelson Education makes a material change to this Privacy Policy, we will post a notice of same on our website and highlight the changes. We may also notify Individuals via email. Material changes to this Privacy Policy will be binding after such changes have been introduced and for which notification of such material changes has been made.
If at any point you do not agree with the terms of this Privacy Policy, you must not use Nelson Education's services.

B. The Privacy Policy - Definitions

Collection - the act of gathering, acquiring, recording or obtaining Personal Information from any source, including Third Parties, by any means.

Consent - voluntary agreement by an informed Individual with respect to the Collection, Use and Disclosure of Personal Information for defined purposes. Consent can be either express or implied and can be provided directly by the Individual or by an authorized representative. Express Consent can be given orally, electronically or in writing but is always unequivocal and does not require any inference on the part of Nelson Education Implied Consent is Consent that can reasonably be inferred from an Individual's action or inaction.

Disclosure - making Personal Information available to a Third Party.

Individual - an individual who: (a) corresponds with Nelson Education, including complaints and including applications for employment; (b) enters a contest sponsored by Nelson Education; (c) uses, or applies to use, the products or services of Nelson Education; or (d) viewers, readers, subscribers, advertisers and Internet users who are exposed to the media content of Nelson Education and about whom Nelson Education collects Personal Information and such other individuals who visits our website, as well as clients, students, teachers, education professionals, and anyone who engages with our products, services and offerings.

Personal Information - information that can identify an Individual directly or indirectly or through other reasonably available means, provided that Personal Information shall not include: (a) business-contact information, such as the name, title or business address or telephone number of an employee of an organization (when such information is used to contact such employee regarding a matter related to their job); (b) information collected, used or disclosed in the course of journalistic, literary or artistic activities; (c) aggregate information that cannot be associated with a specific person, such as demographic statistics about Nelson Education customers, or number of visitors and average time spent on a website; or (d) information that is determined not to be Personal Information pursuant to applicable privacy legislation.

Third Party - a person other than an Individual or his agent, or an organization other than Nelson Education

Use - the processing, treatment, handling, and management of Personal Information by Nelson Education
